Terms and Conditions for Landscape & Vegetation Services. Please read these Terms and Conditions  carefully before using the http://www.landscapeandvegetationservices.com.au  website and physical services operated by M & C Sager Pty Ltd T/A Landscape & Vegetation Services.

 

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. Termination clause for websites that do not have accounts. If your website or mobile app allows users to register and have an account, create your own Terms and Conditions.

 

Termination -

 

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

You further acknowledge and agree that M & C Sager Pty Ltd T/A Landscape & Vegetation Services shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third­-party web sites or services that you visit.

 

Governing Law-

 

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service after every job number in its completion.

 

Changes-

 

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

 

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

 

 

Physical Services-

 

Any hands on services provided by M & C Sager Pty Ltd T/A Landscape & Vegetation Services are provided with the following of the Australian Legal Building, OHS, Depth, Environmental and Boundary Standards. 

Any suggestion otherwise by a client during the works, will not be carried out. Work will cease until agreement is met, otherwise  job stage completion costs will be owed by the client.

 

Landscaping carried out under a clients design to cut costs, can be carried out if the design meets the Australian Legal Building, OHS, Depth,Environmental and Boundary Standards. However if on completion of the job the client has change of mind, M & C Sager Pty Ltd T/A Landscape & Vegetation Services has carried out the initial request and any changes there after will involve re-quoting. Changes to the initial job will see the bill paid in full on progressed stage, before the new change in works can begin. A deposit may also be required as a new job number is required.

 

Responsibilities-

 

Any work that M & C Sager Pty Ltd T/A Landscape & Vegetation Services complete which involves turf laying "DOES NOT" include the continued care and maintenance of the freshly laid turf. This service can be provided on request at an additional cost.

 

Any work that  M & C Sager Pty Ltd T/A Landscape & Vegetation Services complete which involves new garden beds and planting of plants "DOES NOT" include the continued care and maintenance of the new garden beds. This service can be provided on request at an additional cost.

M & C Sager Pty Ltd T/A Landscape & Vegetation Services take all due care when working on sites and take no responsibility of any damage caused by unforeseen, misled or acts of nature caused during the times of construction.Every possible caution is taken when dealing in confined workspaces, pool area's, high traffic and area's with children.

When working in area's with children or people it is the parent/guardians responsibility to supervise the children if so happen to enter the work site. M & C Sager Pty Ltd T/A Landscape & Vegetation Services advise no entry, & take nil responsibility of any injuries that  may occur. 

 

Worksite Safety-

 

It is at M & C Sager Pty Ltd T/A Landscape & Vegetation Services discretion to decide whether a job/work site is safe for works to be carried out.If deemed unsafe it is at clients cost for a job/work site to be made safe for works to begin.M & C Sager Pty Ltd T/A Landscape & Vegetation Services can provide all the legal requirements and man hours to create a safe job/work site, if the client does not wish to do so them-self, which is invoiced on the clients bill.

 

Rates-

 

It is at M & C Sager Pty Ltd T/A Landscape & Vegetation Services discretion and without notice to change scheduled rates.If rates are quoted and quote expires the listed quote valid time of 30 days, a re-quote may be needed therefore a rate change could take place.

If a quote has been accepted and a job booking is confirmed by a deposit being paid and it is inside the 30 day valid term, rates are left as is. Quote/estimate will be revised if document is outside of the 30 day term and  third party/ suppliers have a rate change on products/materials. In return which will be passed on and a revised quote/estimate will be submitted with a new 30 days term valid period. (Rates term excludes Commercial waste disposal and supplier products)

 

Deposits-

 

If a deposit has been paid and a job booking confirmed and a client wishes to cancel, a non refundable fee of $100.00 is withheld.  The value of the products/materials already ordered/purchasd, only if they can not be returned to M & C Sager Pty Ltd T/A Landscape & Vegetation Services suppliers. All monies will be refunded minus the value of products/materials plus the $100.00.

If products/materials can be returned to M & C Sager Pty Ltd T/A Landscape & Vegetation Services Suppliers the product value will be refunded and will be forwarded to client. A $100.00 non refundable fee still remains.Refundable time frame is at the discretion of the third party material/suppliers which M & C Sager Pty Ltd T/A Landscape & Vegetation Services has no control or say over.

Additions-

​

Any additions made by a client to a project once the project has commenced or the has been contract signed, will require the requested addition in writing by the client to the company. Some additions may require an estimate drawn up and pending available time to carry out the additional work, rescheduling may be required.

Weather Pending-

 

 M & C Sager Pty Ltd T/A Landscape & Vegetation Services has the right to call a day early or delay the start of a job due to weather issues.

No correspondence will be entered into on this issue.

 

Turfing

 

Sometimes due to weather turf can not be cut or supplied from  suppliers. If there is a rain event turf is too wet to be cut resulting in no turf for a scheduled job. This is out of our control and out of a suppliers control. 

 

Pets

 

If you have pets it is advised that when a scheduled visit is to be carried out that you either chain your pet up or seek alternate housing arrangements. We do everything we can to contain a clients pet & make it comfortable with our presence, however accidents do happen pets do sometimes escape or attack and M & C Sager Pty Ltd T/A Landscape & Vegetation Services  do not take responsibility if a pet gets scared or frets and runs away. If  this does happen we do however notify local vets and councils and clients immediately. It is a good idea to share your pets names with us so they can feel comfortable around us.

 

 

Deposits

​

All Projects in excess of $700.00 require a deposit. All deposits are 25%-50%. Amount is at M & C Sager Pty Ltd T/A Landscape & Vegetation Services discretion depending on project and material size. Receipts are issued to client after all funds are cleared into company accounts.All deposits must be paid prior to project commencement.

Water Usage

 

Most projects require water during the duration. We do realise this is at cost to our clients so we do apply sparingly as required. 

Water usage for on going upkeep of your new installations will show an increase in your rates that we,  M & C Sager Pty Ltd T/A Landscape & Vegetation Services take no responsibility for. Gardens and turf do require excessive water for optimal establishment.

Unforeseen Obstructions

 

Any unforeseen obstructions are payable by client. These can not be quoted for as they are not always a problem or be seen at time of quoting. They are payable by Client as an Extra on final Tax Invoice. Unforeseen Obstructions can be anything from relocation of services to rock breaking. Jobs that may come across but not limited to these problems are footings for decks or posts & large holes for advanced plantings.

Commercial Tip

All commercial waste being Commercial General Waste and/or Construction Demolition Waste, Clean Fill,Timber or Concrete is weighed by the Tonne at the Council waste facility and charged accordingly on the clients Final Tax Invoice. Estimated units per Tonne are provided on estimation. Estimated units are estimation only and are for guidance only and do not reflect the exact amount of commercial waste that could or could not be removed. Estimated waste units do not include unforeseen objects subsurface or that created of additional work.

PLANTS and ORGANIC MATERIALS

 

Please choose your plants carefully when requesting species or choosing from our suggestion lists. Plants or organic materials are non refundable. Due to the organic nature, plants and organic materials can not be returned to the supplier due to fire-ant laws.

Unpaid Tax Invoice

 

All invoices must be paid within 7 days as stipulated on Tax Invoice itself.

All materials used on any project remain property of M & C Sager Pty Ltd T/A Landscape & Vegetation Services until paid in full by "YOU" the client.

Any debt and associated fees requiring collection by a third party will be paid by "YOU" the client

Overdue invoices are sent out on a 7 day basis. Any charges "WE" M & C Sager Pty Ltd T/A Landscape & Vegetation Services incur for seeking payment will be forwarded onto "YOU" the client.

Accepting a quote is accepting all of "OUR" M & C Sager Pty Ltd T/A Landscape & Vegetation Services,  Terms & Conditions.

Unpaid Tax Invoices after 30 days will incur 5% interest to the outstanding balance, compounding and charged weekly.
